Property Information Forms are prepared by the Law Society as part of its conveyancing Protocol. They have been designed to improve the conveyancing process by obtaining accurate information at an early stage in the transaction.
The protocol forms consist of the following :-
- The Property Information Form (TA6)
- Fittings and Contents Form (TA10)
- Leasehold Information Form (TA7)
These are completed by the sellers (the person or persons who are named as owner on the deeds or Land Registry title or by the owner’s legal representative(s) if selling under a power of attorney or grant of probate or representation).
The Property Information Form includes the questions most frequently raised when dealing with the sale of a property, together with any guarantees, planning consents, building regulation approvals and other relevant documents that they may hold.
The Fittings and Contents Form sometimes referred to as the Fixtures and Fittings list explain items and belongings that are to remain. Fixtures are attached to and form part of the land and property, but fittings are only included in the sale if the seller expressly agrees to leave them behind. Disputes over such items are not uncommon and this form is intended to provide clarity for both the seller and the buyer as to what is being included in the sale within the price agreed, and what is excluded from it. The fixtures and fittings form will constitute part of the contract and must be accurate, as it will be binding once contracts have been exchanged. The form covers items from basic fittings or fixtures like doorbells to freezers, curtains and clothes lines.
The Leasehold Information Form is completed on a Leasehold Title only and clarifies information relating to rent, the Freehold owner and Management.
All of these forms are very informative and taken together, these forms can make a real difference to the speed at which transactions can proceed.
