With Brexit looming there may never have been a time when the UK’s productivity is more important.
Malingering, “the intentional production of false or grossly exaggerated symptoms, motivated by external incentives such as avoiding work…” whilst still receiving a salary, is a problem most, if not all, employers must face at some time. A recent report shows that workplace absence is costing the UK economy £18bn in lost productivity, potentially rising to £21bn by 2020, which is why it is necessary for us to tackle this problem now.
It can often be difficult to assess whether an employee is malingering. Whilst we may suspect this is happening, knowing how to deal with it and avoid potential discrimination claims, is an area of concern for most employers. There are simple steps employers can take to deal with staff suspected of malingering.
There are several medical options available to assist employers, however some may be more detrimental and should be avoided.
At Beers Solicitors our HR and Employment Law Specialists can efficiently and effectively guide employers through an investigative process.
